Changes to  Australian Student Visa Work Restrictions

 Effective immediately, Subclass 500 Student visa holders can now work extra than forty hours according to fortnight without being taken into consideration in breach of their visa conditions.

The Australian Government has announced changes to address the current labor shortage with the aim of supporting Australian businesses and the economic response to COVID 19.

 Work Limitations

Student visas currently have a work restriction of 8105. There is a limit to the number of hours you can work, and you can only work after you start studying.

The government has introduced “relaxation” of work restrictions so that student visa holders can start working for an unlimited amount of time as soon as they arrive in Australia or are granted a student visa. You don’t have to wait for the course to start.

Other Conditions

Relaxation of work restrictions does not change other conditions for student visas, including condition 8202:

  • Must be enrolled in a full-time registered course;
  • Ensure satisfactory course attendance; and
  • Ensure satisfactory course progress.

Student visa holders who do not meet Condition 8202 (due to missing course, cancellation of registration, or inadequate progress of the course) have violated the visa and can revoke the visa.

 Time Limits

The announced changes are temporary and will be reviewed in April 2022. Students and employers need to monitor migrants for changes to ensure that migrants are kept up to date.

 Visa Fee Refunds

As an incentive to have Student visa holders go back to Australia as quickly as possible, the Australian Government is imparting money back of the visa application charge for people who journey right here between 19 January and 19 March 2022. An application for the refund can be made up till 31 December 2022.

Student visas are at the listing of eligible visa types for access while not having a Travel Exemption. Applicants and holders have to be capable of showing their vaccination status with the aid of offering a Foreign Vaccination Certificate or proof of Medical Exemption.
